How to report Hyperliquid taxes in 2026

updated october 2026 · ~6 min · not tax advice

No form doesn't mean no tax

Hyperliquid is a non-custodial exchange on its own L1: no KYC, no account statements, no 1099-DA — and after the April 2025 repeal of the DeFi broker rule, none is coming. The obligation to report every taxable event is unchanged; the paperwork is simply never generated for you.

The practical trap: your activity is invisible until it isn't. The moment USDC from your Hyperliquid wallet touches a KYC'd exchange, that exchange reports the proceeds to the IRS with no cost basis attached. What you can't reconstruct then becomes your problem.

What a Hyperliquid record actually contains

Four streams matter. Fills (perp closes with exchange-computed realized PnL and signed fees — a positive fee is a rebate, not a cost). Funding payments (settled hourly — an open position accrues 8,760 events per year). The ledger (deposits, withdrawals, sends, sub-account and spot transfers — each crossing a boundary that decides whether it moves account value). And the sampled portfolio curves (the venue's own account-value and PnL history).

Two traps live in the access layer. The venue's fill endpoint (userFillsByTime) only retains roughly the last 30 hours — a 'full year' export built on it silently contains ~1% of the window. And builder-dex markets (HIP-3 venues like xyz, flx, vntl) now carry over half of perp volume, but tools that enumerate only the main perp book miss them entirely.

What's taxable (the honest version)

Realized perp PnL is taxable when a position closes — almost certainly short-term capital gain/loss on Form 8949, because Hyperliquid isn't a CFTC-registered board of trade so Section 1256's 60/40 treatment doesn't apply.

Funding has no direct guidance. The conservative reading: funding received is ordinary income, funding paid is a deductible expense; some filers net it into position PnL instead. What matters is that your method is documented and consistent — and that the underlying numbers are complete.

The November 2024 HYPE genesis airdrop was ordinary income at fair value on receipt for US persons; that value becomes your basis. Staking rewards follow the same receipt-at-value rule.

How to reconstruct it defensibly

Step one is not picking software — it's getting complete data. Fill history must come from a chain indexer (the venue API drops everything older than ~30 hours). Funding and ledger history do serve full history from the venue API.

Step two is verification, not trust. Our free check recomputes your record fill by fill and then closes an independent identity — Δ account value minus every boundary flow must equal the venue's PnL. On ordinary accounts this closes within dollars on hundreds of millions of flow; when it doesn't close, the measured disagreement is printed with its cause.

Step three is classification — jurisdiction-specific, and deliberately not what this tool decides. The exported evidence goes to your tax software or CPA with clean, verified totals.

Paste your address and the check recomputes every fill, sums funding and signed fees, and closes the account-value identity — with a PDF you can hand to whoever files for you.
